Idaho Must Allow Gender Changes on Birth Certificates (USA)

On March 5, 2018 U.S. Magistrate Judge Candy Dale issued a decision in a lawsuit brought by individuals who identify as transgender seeking to change their identifying documents to reflect their “gender identity,” holding that the “rules by the Idaho Department of Health and Welfare violate the Equal Protection Clause of the U.S. Constitution.” Judge Dale ordered the state to begin considering applications from individuals seeking to change the sex listed on their birth certificates under new rules by April 6, and that the reissued birth certificates cannot include a record of the original sex listed on the documents.
