Deon “Strawberry” Hampton is a man who identifies as a transgender woman. He is currently serving a 10-year prison sentence for burglary. In 2017, he filed a federal lawsuit seeking a transfer from the men’s prison where he is serving his sentence to a women’s prison, alleging mistreatment on the basis of his “gender identity.” Following an evidentiary hearing in front of a U.S. Magistrate Judge which focused on ““Hampton’s gender identity and on whether [he] could pose a risk to female inmates if moved,” he was transferred to Lawrence Correctional Center, another men’s prison.
On March 8, he filed another federal lawsuit against the Illinois Department of Corrections again seeking transfer to an all-female prison, alleging he is still being mistreated at the men’s prison and is in “such despair” that he “tried to kill [him]self.”
Placing a male inmate in an all-female facility would violate the civil rights of every woman incarcerated there under the UN’s Standard Minimum Rules for the Treatment of Prisoners.
