Vermont Representative Brian Campion has introduced S.B.128 to prohibit criminal defendants from pointing to a crime victims’ sexual orientation or gender identity as justification for criminal behavior against the victim. This is a good bill to remove potential “gay panic” defenses. However, we have some concern about this legislation providing cover to Male “lesbians” who prey on Women. The bill provides that “(n)either a nonviolent sexual advance nor the discovery of a person’s sexual orientation, sex, or gender identity shall constitute a legally adequate provocation to mitigate the offense of murder to manslaughter, or to mitigate the severity of any other offense.” It is well known that there are Male “lesbians” who view sexual access to Gay Women as a civil right.
