Emily Esque is the Twitter name of a Washington, D.C. lawyer who has written an email to the U.S. Department of Education asking the Department to weigh in on a Gloucester (Virginia) School Board decision to restrict use of the girl’s bathrooms to girls (and the boy’s room to boys). The Virginia school board policy directs transgender students to use single-stall restrooms in lieu of using the restroom designated for their sex.

We support the use of single-stall restrooms for all transgender students as a reasonable compromise to afford female students privacy away from male students who identify as girls. This is, in our view, a more significant issue in the context of locker rooms and other spaces where girls have a heightened expectation of privacy.
