The Equal Employment Opportunity Commission is suing Lakeland Eye Clinic, a Lakeland, Fla.-based organization of health care professionals, for allegedly discrimination against Brandi Branson based on sex in violation of federal law. The EEOC claims the defendant fired Branson because he is transgender, because he was transitioning from male to female, and/or because he did not conform to the employer’s gender-based expectations, preferences, or stereotypes. According to the EEOC’s lawsuit against Lakeland Eye Clinic, Branson had performed his duties satisfactorily throughout his employment. However, after he began to present as a woman and informed the clinic he was transgender, Lakeland fired him.
We hope Branson wins, because this is sex discrimination based on sex stereotypes about what a man can look like.
